Jose Garcia No Longer Running From Medicare Fraud Charges; Benitez Brothers Still At Large

Today, Jose Garcia appeared in a Miami Court after being a fugitive for more than two years.  The Judge ordered Garcia detained until the resolution of his charges.  Garcia was indicted on Medicare Fraud charges resulting in $10.9 million in false claims to Medicare and paying health care kickbacks. Garcia’s co-conspirator, Nayda Freire, was sentenced to 30 months in prison and to pay $7,992,391 in restitution after pleading guilty and acknowledging the false claims to Medicare for unnecessary or fake HIV infusion services.  Garcia and Freire placed money received from Medicare into sham companies owned by co-conspirators, Carlos and Luis Benitez and Thomas McKenzie.   Mckenzie is serving a 14 year prison sentence and will pay $84 million in restitution.  According to DoJ, the Benitez brothers remain fugitives.
